Terms of Service

These Terms of Service ("Terms") govern your access to and use of Girl Dad App, the Founding Fathers beta program, and related websites and services operated by First Hero LLC ("First Hero," "we," "us," or "our"), including firsthero.com and girldad.app. By creating an account, submitting an application, or using the service, you agree to these Terms.

1. Eligibility

Girl Dad App is intended for adults, especially fathers and adult caregivers. You must be legally able to enter into a binding agreement in your location to create an account or participate in the Founding Fathers beta.

Children should not create accounts or use the service directly. If you add information about a daughter, child, or family member, you confirm that you have the right to provide that information and use it in the app.

2. What Girl Dad App Provides

Girl Dad App helps fathers build intentional presence through Quests, Rituals, Adventures, memories, reflection, reminders, progress tracking, Community features, and AI-supported coaching. The service may also include applications, beta programs, research, events, and related communications.

Girl Dad App is not therapy, medical care, legal advice, financial advice, crisis support, or a substitute for professional counseling. The app supports reflection and action, but it does not diagnose, treat, or guarantee any parenting, relationship, emotional, family, health, legal, or financial outcome.

If you or someone else may be in danger, contact emergency services or an appropriate professional immediately.

3. Your Account and Applications

You are responsible for keeping your login information secure, for all activity under your account, and for providing accurate, current contact information.

You may not create an account for another person without permission, impersonate anyone, or use Girl Dad App in a way that violates another person's rights.

Submitting a Founding Fathers application does not guarantee acceptance, beta access, a lifetime seat, or any particular benefit unless First Hero confirms it in writing.

4. Family, Daughter, and Personal Information

You may choose to add information about yourself, your daughter, your family, your goals, memories, routines, activities, and app progress. Use care with what you enter, especially when it relates to children, family conflict, health, school, location, or other sensitive topics.

Do not enter information you do not have the right to share. Do not use Girl Dad App to store emergency information or information that needs professional, legal, medical, or crisis handling.

5. AI Coaching and Generated Content

Girl Dad App may use AI systems to generate coaching responses, suggestions, summaries, Quests, Rituals, Adventures, or other content. AI-generated content may be incomplete, inaccurate, or not appropriate for every situation.

You are responsible for your choices and actions. Use your judgment before relying on AI-generated content, especially in situations involving safety, health, legal issues, emotional distress, family conflict, custody issues, abuse, self-harm, or urgent concerns.

6. Your Content

You keep ownership of the content you provide to Girl Dad App. You give First Hero permission to host, process, display, modify, and use that content as needed to operate, secure, personalize, support, and improve Girl Dad App.

This permission includes processing your content through service providers that help us operate the app, including hosting, database, email, notification, calendar, support, security, and AI providers.

7. Notifications, Email Nudges, and Calendar Features

Girl Dad App may send account, security, support, legal, and operational messages related to your account or application.

If you enable email nudges, push notifications, or calendar features, we may use your account information, app activity, notification preferences, scheduled adventures, and related app signals to send reminders or create calendar events. You can change notification preferences in the app or use unsubscribe or preference links where provided.

Turning off optional nudges does not stop necessary account, security, support, payment, or legal messages. Text messaging is governed separately by Section 8.

8. Girl Dad App SMS Program

The sender for this messaging program is Girl Dad App by First Hero LLC.

Consent is optional and is not a condition of applying, purchasing, participating in the Founding Fathers beta, or receiving the service.

Wireless carriers are not liable for delayed or undelivered messages.

If you separately and expressly opt in through a Girl Dad App or First Hero form, we may send recurring automated marketing text messages to the mobile number you provide. Messages may include updates about your Founding Fathers application and beta participation, beta-access or onboarding instructions, scheduled Quest and session reminders, essential program notices, product news, feedback requests, invitations, and offers related to Girl Dad App or First Hero. A disclosure shown at the point of opt-in may describe a narrower messaging program; if so, your consent is limited to that disclosed program.

Message frequency varies. Message and data rates may apply. Your mobile carrier's terms and charges apply. Carriers are not liable for delayed or undelivered messages. Message delivery and program availability are not guaranteed and may depend on your carrier, device, and location.

SMS consent is optional and is not a condition of applying, purchasing, participating in the Founding Fathers beta, or receiving the service. Providing a mobile phone number, submitting an application, accepting these Terms, or agreeing to receive application emails does not by itself enroll you in recurring text messages.

Reply STOP to unsubscribe. We may send one final message confirming your opt-out, after which we will stop messages covered by that consent unless you separately enroll again. We also honor reasonable revocation requests, including clear requests made by replying to a message or emailing cory@firsthero.com. Reply HELP for help or contact cory@firsthero.com.

You represent that you are the subscriber or customary user of the mobile number you provide and are authorized to consent to messages at that number. If your number changes or is reassigned, you agree to notify us or opt out before discontinuing use of the number.

First Hero may change or end the messaging program, but we will not use an existing consent to send messages from an unrelated sender or about an unrelated program. Consent records and opt-out or suppression records may be retained as described in our Privacy Policy.

We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. We may disclose mobile information only to service providers acting on our behalf to operate the messaging program or when required by law. Those providers may use the information only to provide services to First Hero LLC and not for their own marketing.

9. Community and Acceptable Use

If Community features are available, you remain responsible for content you post and for respecting the privacy and safety of others. Private reflections, journal entries, memories, coaching conversations, and daughter information are not automatically posted to Community.

You may not use the service to harass, exploit, threaten, shame, manipulate, or harm another person; post unlawful, abusive, or infringing content; expose another person's private information without permission; attempt to access another user's account; interfere with the service; introduce malicious code; reverse engineer protected portions of the service; or use the service in violation of law or another person's rights.

We may remove content or restrict access when reasonably necessary to protect users, enforce these Terms, or comply with law.

10. Payments and App Stores

If paid plans, subscriptions, trials, or purchases are offered, the applicable price, billing period, renewal terms, cancellation process, and refund rules will be shown before purchase. Purchases through Apple, Google, Stripe, or another provider may also be governed by that provider's terms.

11. Ownership and Feedback

First Hero owns Girl Dad App, including the app, software, design, branding, original content, trademarks, logos, technology, and related intellectual property, subject to third-party rights. These Terms do not transfer ownership of Girl Dad App to you.

You may send feedback or suggestions. If you do, you allow First Hero to use that feedback without restriction or compensation.

12. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect information, including mobile information and SMS consent. By using the service, you acknowledge the Privacy Policy.

13. Account Deletion and Termination

You may request account deletion through the app or any account-deletion process we provide. We may retain limited information when needed for security, legal compliance, billing, fraud prevention, dispute resolution, backups, communication suppression, or operational records.

We may suspend or terminate access if you violate these Terms, create risk for First Hero or other users, or use the service unlawfully.

14. Changes to the Service or These Terms

We may update Girl Dad App or these Terms from time to time. If we make material changes, we will provide notice as appropriate. Continued use after updated Terms take effect means you accept the updated Terms where permitted by law.

15. Disclaimers

Girl Dad App is provided "as is" and "as available." We do not guarantee that the service will be uninterrupted, secure, error-free, or that it will produce any specific result.

To the fullest extent allowed by law, First Hero disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

16. Limitation of Liability

To the fullest extent allowed by law, First Hero LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or relationship, parenting, emotional, family, health, legal, or financial outcomes.

Some jurisdictions do not allow certain limitations, so some of the limitations above may not apply to you.

17. Governing Law

These Terms are intended to be governed by the laws of Arizona, without regard to conflict-of-law rules, unless another law applies and cannot be waived.
